The Provision and Use of Work Equipment Regulations 1998

Employers must ensure that work equipment is suitable for the purpose it is used or provided

In selecting work equipment, employers shall have regard to the working conditions and to the risks to the health and safety of persons which exist in the premises or undertaking in which that work equipment is to be used and any additional risk posed by the use of that work equipment.

Employers shall ensure that work equipment is used only for operations for which and under conditions for which it is suitable.

Employers shall ensure that work equipment is maintained in an efficient state, in efficient working order and in good repair.

Employers shall ensure that work equipment is inspected to ensure that it is safe to operate.

Employers shall ensure, where a specific risk to health and safety arises from the use of work equipment, that the use of it shall be restricted to those persons given the task of using it.

Employers shall provide health and safety information and adequate training on the use of work equipment, to all persons who use it.

Employers shall ensure that work equipment is stabilised by clamping or otherwise where necessary for purposes of health or safety

Employers shall ensure that work equipment is marked in a clearly visible manner with any marking appropriate for reasons of health and safety.
